1. General Purpose and Scope
These Terms and Conditions ("Terms") govern your use of A2P (Application-to-Person) text messaging services provided by Titan Plumbing and Electric ("Company," "we," "us," or "our"). By providing your mobile phone number and expressly consenting to receive text messages, you agree to be bound by these Terms in their entirety. These Terms apply to all SMS communications sent through our designated sender number (+1 656-236-0628) via our SMS service provider, GHL.
2. Eligibility and Age Requirement
You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement to use our SMS messaging services. By providing your mobile phone number and consenting to receive text messages, you represent and warrant that you are eighteen (18) years of age or older. If you are under eighteen (18) years of age, you are not authorized to use our SMS service. If we determine that a user is under the required age, we reserve the right to remove their information and terminate their participation in the SMS program immediately.
3. SMS Service Description
Titan Plumbing and Electric provides A2P mobile messaging services for communication and marketing purposes through our SMS service provider, GHL. All messages are sent from our designated sender number: +1 656-236-0628. The following types of messages may be sent:
Transactional / Operational
- Appointment reminders and scheduling confirmations
- Service updates and project notifications
- Estimate requests and service follow-ups
- Emergency service notifications and alerts
- Payment reminders and billing communications
Marketing / Promotional
- Special offers, promotions, and seasonal campaigns
- New service announcements
- Service area expansions and community updates
- Customer satisfaction surveys (CSAT)
Message frequency varies based on your inquiries, scheduled services, active projects, and marketing campaigns. During periods of active service, you may receive multiple messages per week. We do not guarantee a specific number of messages.
4. SMS Provider and Platform
Our A2P SMS services are delivered through GHL ("Service Provider"), a third-party SMS gateway and marketing automation platform. By consenting to receive SMS messages from Titan Plumbing and Electric, you acknowledge and agree that your mobile information will be processed by GHL in accordance with its own terms of service and privacy policy. Titan Plumbing and Electric remains solely responsible for the content of all messages sent and for compliance with all applicable federal and state laws governing SMS communications.
5. Consent and Mobile Number
Your consent to receive SMS messages is obtained through an explicit opt-in mechanism. By providing your mobile phone number through our website, landing page, or in-person at a service location, and checking the SMS consent box or verbally confirming your consent, you expressly agree to the following:
- You authorize Titan Plumbing and Electric and its SMS service provider (GHL) to send SMS messages to the mobile number you have provided.
- Your mobile phone number will be used solely for the purposes described in these Terms and our Privacy Policy.
- You are not required to consent to marketing messages as a condition of purchasing any goods or services.
- Your consent is not obtained through any automatic telephone dialing system (ATDS) or artificial voice, as defined by the Telephone Consumer Protection Act (TCPA).
- You have the right to withdraw your consent at any time as described in Section 6.
- We maintain records of all SMS consents, including the date, time, and method of opt-in, for a minimum of four (4) years in accordance with federal and state record-keeping requirements.
6. Opt-Out, Stop, and Support Mechanisms
You may cancel your participation in the SMS program at any time, without cost, through any of the following methods:
- Reply "STOP" to any text message received from +1 656-236-0628.
- Reply "UNSUBSCRIBE" to any text message received from +1 656-236-0628.
- Contact us directly at (813) 933-8010 during business hours.
- Send an email to manager@titanplumbingandelectric.com requesting removal from the SMS list.
Upon receipt of your STOP, UNSUBSCRIBE, or opt-out request, Titan Plumbing and Electric will send a confirmation text to your mobile number acknowledging your unsubscription. You will no longer receive marketing or promotional SMS messages within 24 hours of submitting your request. Transactional and service-related messages may continue to the extent you have an active service relationship with us.

7. Customer Satisfaction Surveys (CSAT)
As part of our commitment to quality service, Titan Plumbing and Electric may send CSAT (Customer Satisfaction) surveys via SMS after a completed service appointment. By consenting to receive SMS messages, you expressly consent to receive these survey communications.
- CSAT survey messages are sent from +1 656-236-0628 following a completed service.
- Survey responses are collected through a third-party survey platform integrated with GHL.
- Participation in CSAT surveys is voluntary and does not affect your service entitlements.
- Survey responses are retained for a minimum of two (2) years for quality assurance purposes.
- Your survey responses may be used to improve our services and customer experience.
8. A2P 10DLC Registration and Carrier Disclosure
Titan Plumbing and Electric's SMS program operates under the A2P (Application-to-Person) 10DLC (10-Digit Long Code) framework governed by the United States telecommunications carriers, including AT&T, Verizon, T-Mobile, and Sprint. All SMS campaigns are registered with relevant carrier programs through our SMS service provider.
- Our SMS campaigns are registered with U.S. carriers under applicable brand and campaign vetting requirements.
- Carrier-approved message templates are used for all marketing and promotional communications.
- Titan Plumbing and Electric does not use random number generation or mass auto-dialing for SMS delivery.
- All messages comply with carrier content policies and applicable federal telecommunications law.
- Fees assessed by U.S. carriers for A2P SMS delivery may be passed to the end user as part of standard messaging rates.
9. TCPA Compliance Notice
Titan Plumbing and Electric complies with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and the Federal Communications Commission (FCC) regulations. By consenting to receive SMS messages, you acknowledge that:
- Consent to receive SMS messages is provided voluntarily and is not a condition of service.
- Titan Plumbing and Electric does not use an automatic telephone dialing system (ATDS) to send SMS messages.
- Messages are sent manually or through semi-automated systems via the GHL platform.
- You may file a TCPA-related complaint by contacting the FCC at 1-888-CALL-FCC or https://www.fcc.gov/complaints.
10. Data Rates and Carrier Charges
Titan Plumbing and Electric is not responsible for any charges, fees, or assessments imposed by your mobile carrier in connection with your receipt of text messages, including but not limited to standard message and data rates, roaming charges, and fees associated with international SMS reception. You are solely responsible for all carrier charges related to your participation in the SMS program. We recommend contacting your carrier for details regarding your messaging plan and applicable rates.
11. Privacy and Data Use
Your privacy is important to us. Please review our Privacy Policy, which is incorporated herein by reference, to understand in detail how we collect, use, store, and protect your personal information, including your mobile phone number. Our Privacy Policy describes our data practices in compliance with applicable Florida and United States federal privacy laws, including TCPA.
12. Disclaimer of Warranties
THE SMS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE MESSAGING SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR TIMELY.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TITAN PLUMBING AND ELECTRIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SMS SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER TITAN PLUMBING AND ELECTRIC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your participation in the SMS program shall be resolved through binding arbitration in Hillsborough County, Florida, in accordance with the rules of the American Arbitration Association (AAA). By consenting to receive SMS messages, you expressly waive your right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
15. Changes to These Terms
We reserve the right to modify, amend, or update these Terms at any time, in our sole discretion. Any changes will be communicated by posting an updated version on our website at https://www.titanplumbingandelectric.com with a revised "Effective Date." Continued participation in the SMS program after any such modification constitutes your express acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Hillsborough County, Florida.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
